ASA CAP Code & Gambling Act 2005

Promotional competitions in the United Kingdom are primarily governed by the Advertising Standards Authority (ASA) CAP Code and the Gambling Act 2005. Free-entry prize draws and prize competitions based on skill are generally exempt from gambling licensing, but operators must meet specific conditions to qualify.

Gambling Act 2005
Prize draws that are free-to-enter, or where a free postal entry route exists, fall outside gambling licensing requirements — provided the draw is conducted randomly and fairly.
ASA CAP Code
Promotions must be administered fairly, the promoter must be identified, odds or number of prizes must be clearly communicated, and winners must be able to receive their prize.
ICO & PECR
Collecting entrant data for marketing purposes requires explicit consent under UK GDPR and compliance with the Privacy and Electronic Communications Regulations.

What UK Promotion Organisers Must Do

Whether running a social media competition, charity raffle, or large-scale prize draw, UK organisers carry full legal responsibility for compliance. SecureDraw documents and certifies the draw outcome — organiser responsibilities listed below remain solely with the organising entity.

Published Terms & Conditions
Full T&Cs must be published before the promotion opens, covering entry eligibility, prize details, closing dates, and how the winner will be selected and notified.
Free Entry Alternative
For paid-entry promotions, a free entry route (e.g., postal entry) must be provided and publicised with equal prominence to avoid gambling classification.
Winner Selection & Notification
Winners must be selected using a fair and random method. Winner details (first name and county) must be made available upon request for 2 months post-draw.
Data Protection
Entrant data must be handled lawfully under UK GDPR. A valid legal basis must exist for processing, and a privacy notice must be provided at the point of entry.
Prohibited Categories
Competitions targeting those under 16 must carry additional safeguards. Alcohol and gambling-adjacent promotions carry sector-specific rules from the ASA and Gambling Commission.

What We Certify

SecureDraw acts solely as an independent adjudication platform. Our certificates record the randomisation method, timestamp, entrant pool hash, and outcome — providing tamper-evident proof that a draw was conducted fairly.

Randomisation Certification
Every draw produces a cryptographically sealed certificate confirming the draw algorithm, seed, timestamp, and selected outcome.
Public Verifiability
Anyone — entrants, regulators, or legal representatives — can independently verify a draw certificate via our public lookup tool.
Dispute Evidence Packs
If a draw result is challenged, SecureDraw can generate a full evidence pack containing the complete audit trail for submission to the ASA or in legal proceedings.
